You are currently using the unitedacceptance.com website (the "Site"). United Acceptance, Inc. provides the information and services located on the Site (the "Services"). Please read these Terms of Use ("Terms of Use") carefully. By accessing this Site you agree to be bound by these Terms of Use.

If you do not agree to these Terms of Use, you may not use this Site and we disclaim any responsibility for your use without further agreement.

1. Definitions

"Mark" means trademark, trade name, service mark, trade dress, logo, custom graphics, or icon.

"Site" means this website and any respective subsidiaries, together with the respective Content, Marks, Products and Services available from this Site and any subsidies.

"UAI" or "we" means United Acceptance, Inc., and its subsidiaries and affiliates.

The terms "Site", "Marks", "Products and Services" do not include the sites, marks, content, products or services that are provided by third parties, and that are available through a link from the Site. Their use is subject to the terms set forth by their respective owners or operations, on the third party's website.

2. Site

These Terms of Use govern your use of all Content, Products or Services available through the Site. You agree to be bound by these Terms, and to use the Site in strict compliance with all applicable laws, rulings and regulations, and in a manner that does not negatively reflect on the goodwill or reputation of UAI.

3. Fees

UAI may charge a fee for the service it provides when you register for Products or Services through the Site. Any such service fee is non-refundable.

4. Insufficient Check Funds Policy

If a check is bounced due to insufficient funds, you will be responsible for paying all returned check service charges and any attorneys’ fees incurred as a result of such insufficient funds.

5. Credit Card Terms and Conditions

By paying online for the Products and Services, you are agreeing to submit your payment through Western Union, the online registration provider for UAI. UAI will be the only name to appear on your credit card statement. In addition, UAI does not offer refunds. In case of refunds or cancellations please contact UAI directly at 1-888-951-9762.

6. Security

Certain sections of our Site are designed to collect and transmit information securely. This site has reasonable security measures in place to protect the loss, misuse, and alteration of the information under our control; however, we cannot guarantee and accept no responsibility for any interception or decryption by others. Users are prohibited from violating or attempting to violate the security of the site.

7. Cookies

Cookies are text files stored on your computer to enhance the usability of a particular website. They can tell a website if you have visited before and can pass short bits of information from the website back to itself the next time you visit. Any information, including personal information, which you choose to provide at a Site may be stored in a cookie. This Site is the sole and exclusive property of UAI or its licensors. The Site is protected by copyright, trademark, patent, trade secrets, unfair competition, and other laws of worldwide, through the application of local laws or international treaties. Any unauthorized use, reproduction or modification of this Site may violate such laws. Do not edit, publish, transfer, sell, or in any way exploit, any of the Content, either in whole or in part.

9. Copyright

The content, organization, graphics, design, and other matters related to the Site are protected under applicable copyrights and other proprietary laws, including but not limited to intellectual property laws. Except as otherwise permitted under copyright law, the copying, reproduction, use, modification, redistribution or publication by you of any such matters or any part of the Site is strictly prohibited, without our express prior written permission.

UAI grants you a limited, personal, nontransferable, non-sublicensable, revocable license to access and use the Site only as expressly permitted in these Terms of Use. Except for this limited license, we do not grant you any other rights or license with respect to this Site; any rights or license not expressly granted herein are reserved.

11. Links

UAI has not reviewed all of the sites linked to its Site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by UAI of the site. Use of any such linked website is at the user's own risk.

12. Registration Information

You may be invited to register at the Site to help us tailor the Services for your personal and business financial needs and to alert you to other products and services for you and/or your business. In registering for the Services, you agree to provide accurate, true, current, and complete information about you and/or your business as requested by the registration screens. As a convenience to you, a profile for you and/or your business may be created based on the registration information that you provide. This profile and any registration information you provide will be protected as described in our Privacy Policy.

13. Limitation of Liability; Disclaimer of Warranties

By using this Site, you expressly agree that use of this Site is at your own risk. The User shall be responsible for protecting the confidentiality of his or her password(s), if any.

14. Authority to Register and/or to Act as Agent

You represent and warrant to UAI that you have full legal authority to complete this registration, including full authority to make use of the credit or debit card to which payments, registration or other fees will be charged. You represent and warrant that all information you supply to us about yourself and others, including email addresses, is true, valid and accurate, and that you have the right to supply us with such information. Minors (as defined under the laws of their jurisdiction or residence) are not eligible to register for or use Products or Services available on the Site. In addition, if you are registering third parties, you represent and warrant that you have been duly authorized to act as agent on behalf of such parties in performing this event registration. By proceeding with this registration, you agree that the terms of this registration agreement, including all financial obligations, shall apply equally to you and to any third parties for whom you are acting as agent.

15. Other Limitations

Unless otherwise provided within these Terms of Use, or unless specific applicable law requires UAI to allow you to do so, you may not do any of the following without the prior written consent of UAI

(a) Use or access the Site in any way that, in UAI’s reasonable judgment, adversely affects the performance or function of the Site, or any other computer systems or networks used by UAI, other Site users or members;

(b) Upload or transmit to the Site or use any device, software or routine that contains viruses, Trojan horses, worms, time bombs, or other computer programming routines that may damage, interfere or attempt to interfere with, intercept, the normal operation of our Site, or appropriate the Site or any system, or take any action that imposes an unreasonable load on our computer equipment, or that infringes upon the rights of a third party;

(c) Use any device, software, or routine that interferes, or attempts to interfere, with the normal operation of this Site, or take any action that imposes an unreasonable load on our equipment; or

(d) Disguise the origin of the information transmitted through the Site.

16. Termination

UAI, in its sole discretion, may, at any time and without advance notice or liability, terminate or restrict your access to all or any component of our Site, even if access continues to be allowed to others. Upon such termination or suspension, you must immediately discontinue use of the Site, and destroy any copy you have made of any portion of the Site. Accessing the Site after such termination, suspension, or discontinuation shall constitute an act of trespass. UAI shall not be responsible to you for such suspension or termination.

17. Disclaimer

THE SERVICES ARE OFFERED ON AN "AS IS," "WHERE IS" AND "WHERE AVAILABLE" BASIS, WITH NO WARRANTY OF ANY KIND-WHETHER EXPRESS, IMPLIED OR STATUTORY. UAI EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, NON-INFRINGEMENT OR THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING, USAGE OR TRADE. THIS DOES NOT AFFECT THOSE WARRANTIES WHICH ARE INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.

YOU ACKNOWLEDGE THAT NEITHER UAI. NOR ITS AFFILIATES, NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS, WARRANT THAT THE SERVICES OR THIS SITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICES OR THE SITE, OR AS TO THE TIMELINESS, SEQUENCE, ACCURACY, RELIABILITY, COMPLETENESS OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE SERVICES AND THE SITE. UAI DOES NOT ENDORSE PRODUCTS OR SERVICES APPEARING ON LINKED SITES OR PURCHASED VIA LINKED SITES. (THIS DOES NOT AFFECT ANY MANUFACTURER'S WARRANTIES THAT THE PROVIDERS OF THE LINKED SITES OTHERWISE OFFER.)

EXCEPT AS SPECIFICALLY PROVIDED IN THIS AGREEMENT OR WHERE THE LAW REQUIRES A DIFFERENT STANDARD, YOU AGREE THATUAI IS NOT RESPONSIBLE FOR ANY LOSS, PROPERTY DAMAGE OR BODILY INJURY, WHETHER CAUSED BY ACCESS TO OR USE OF THE SERVICES OR THE SITE. TO THE MAXIMUM EXTENT PERMISSIBLE UNDER APPLICABLE LAW, UAI WILL NOT BE RESPONSIBLE TO YOU OR ANY THIRD PARTY CLAIMING THROUGH YOU FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, LOST PROFITS, SPECIAL OR CONSEQUENTIAL, ECONOMIC OR OTHER DAMAGES ARISING IN ANY WAY OUT OF THE INSTALLATION OR USE OF THE SERVICES, THE SITE, ANY ON-LINE SERVICES OR INTERNET BROWSER SOFTWARE, INCLUDING LIABILITY ASSOCIATED WITH ANY COMPUTER VIRUSES WHICH MAY INFECT YOUR COMPUTER SYSTEM.

18. Indemnification

As a condition of your use of this Site, you agree to indemnify, defend and hold harmless UAI, its affiliates and their respective officers, directors, employees, agents and assigns, from and against any and all claims, damages, liabilities, losses, costs or expenses (including reasonable attorneys’ fees) arising out of, relating to or resulting from your use or attempted use of this Site.

19. Governing Law

Any claim relating to United Acceptance, Inc.’s website shall be governed by the laws of the State of Georgia without regard to its conflict of law provisions.

20. General

United Acceptance, Inc. reserves the right to modify or terminate the Services and the Site or to terminate your access to the Services and Site, in whole or in part, at any time.

21. Entire Agreement

This Agreement, UAI’s Privacy Policy and any operating rules for UAI constitute the entire agreement and replace all previous written or oral agreements between the parties.

22. Severability

If a court finds any of these Terms of Use to be unenforceable or invalid, that Term will be enforced to the fullest extent permitted by applicable law and the other Terms will remain valid and enforceable.

23. Headings

The headings in these Terms of Use are for your convenience and reference; they do not limit or affect these Terms of Use.

24. Assignment

You may not assign, delegate, or transfer your rights or obligations under these Terms of Use.

25. Waiver

Neither the failure nor any delay to exercise a right or remedy under these Terms of Use shall operate as a waiver thereof, nor shall any single or partial exercise of a right or remedy preclude any further exercise of the same.
